General Description (概要)

Deepening the study of international law on the basis of the achievements acquired in International Law I.
国際法Iの基礎の上に、現代国際法学の高度な課題を扱う。
This course is to deepen the understanding of public international law (IL), taking up traditional to the contemporary controversial issues from the legal point of view. The course covers the basic principles and regulations, and on to apply these laws to the international courts’ cases and situations concerned to the international community. The course addresses ‘peaceful settlement of disputes’ as a central issue in international law and the specific branch of international law, i.e. international humanitarian law, human rights law, refugee law, and European law.

1. Review the framework of IL, analysing from the legal point of view 2. Identify how IL applies in contemporary issues. 3. Understand the specific branch of international law and EU law.

1/2(05/12/14) -Introduction of the class -Defining IL Q1. Is international law really 'law'? Reviews of the functions of a legal system Reading materials ・review basic IL textbook (bring one of the most readable IL textbooks to the class) ・Senkaku Island dispute ・Crimea annexation
3/4(12/12/14) Peaceful Settlement of disputes / ICJ 5/6(19/12/14) Use of force / collective self-defense/UN+ sanctions 7/8(09/01/15) International humanitarian law/International criminal law 9/10(16/01/15) International Refugee Law: International Protection 11/12(23/01/15) International Refugee Law: Asylum 13/14(30/01/15) International Human Rights Law: 15/16(13/02/15) International Human Rights Law 17/18 (20/02/15) European Law 27/02/15 Submit a resarch report (a short essay in 4000 to 5000 words)
・Two topics (depending on number of students) are assigned for student’s presentation in the class, and later select one of them for their final report (essay). Some topics might be changed in case you have a particular interesting topic i.e. international environmental law, and that is decided on the first day of the lecture.

1. Students must read listed readings for preparation of presentations and discussions in a class. 2. The instructor will inform students about the details of the grading policy and how to take lectures and when and how to make presentations at the beginning of the class. 3. Enthusiastic participation in discussions is required.
