General Description (概要)

The course deals with refugee law (RL) in the context of international human rights law (IHRL). Participants to the course attain appropriate understanding of the international legal framework to protect refugees, asylum-seekers, internally displaced persons and stateless persons. In particular, the course focuses on the procedure of refugee status determination (RSD) to grasp the role of RL in IHRL. Main topics of the course cover cutting edge issues of asylum, for instance, war, gender, LGBT, and serious form of discrimination.
本コースでは、難民法を国際人権法の文脈で考える。受講生は本コースを通じ、難民、庇護申請者、国内避難民、無国籍者の保護に係る法的枠組を理解することとなる。国際人権法における難民法の役割を理解するため、本コースの焦点は特に難民認定手続に置かれる。本コースの主要な論点には庇護に関する最先端の課題、たとえば、戦争、ジェンダー、LGBT、重大な形態の差別などが含まれる。
Participants to the course are supposed to attain appropriate understanding of the international legal framework to protect refugees and asylum-seekers. In particular, the course deals with refugee status determination (RSD) to grasp the role of RL. Main topics of the course cover cutting edge issues of asylum, for instance, war, gender and serious form of discrimination.
The participants to the course experience practical perspectives of RL. The former part of the course sets out theoretical framework, and the latter part provides participants with an opportunity of training for RSD in practical use. This part forms a style like law clinic in collaboration with a law farm in Tokyo which has been heavily involved in RL cases. The participants consider a real case of refugee claim. An attorney from the law firm takes part in the sessions of the moot court. Some participants are expected to play the role of refugee claimant, public officer and their representatives during the moot court.
Previous study of international law would be some help, but it should be emphasised that it is not a requirement.
